Foundations Certification – Terms & Conditions

Company: Marvelous Works LLC (“Company,” “we,” or “us”)
Student: The enrolled participant (“Student,” “you,” or “your”)

By enrolling in the ColorEssence Foundations: 12-Season Color Analysis Certification Program (the “Program”), you agree to the following Terms & Conditions. Your acceptance via checkbox at checkout constitutes your digital signature and binding agreement.

1. Program Description

The Program is a 6 module professional training that equips you to conduct accurate, ethical seasonal color analysis using the ColorEssence 12-Season Method.

The training portion is delivered over 6 pre-recorded modules, with completion quizzes per section. You will also be required to complete book report and capstone project to fulfill certification requirements.


Certification is awarded only upon successful completion of all required modules, assessments, and licensing agreements. Enrollment does not guarantee certification.

2. Eligibility

You must:

  • Be at least 18 years of age and legally able to enter into a binding contract.
  • Enroll for your own participation (no proxy attendees).
  • Have basic technology skills to access online materials, submit assignments, and participate in assessments.

3. Access & Delivery

The Program is delivered online through a secure portal.

Includes pre-recorded lessons, quizzes, templates, and assignments.

Prior to certification, you will have access to Program content for 6 months from your enrollment date, with the option to extend access in 3-month increments as described in Section 5, for as long as needed to complete certification.

Once certified, you retain lifetime access to Program content as it existed at the time of your certification, for as long as the Program remains active. If the Program is retired, the Company will provide reasonable advance notice before access closes.

Your ColorEssence Certified™ title, badge, and licensed use of Company-provided templates and brand assets are granted permanently, as described in Section 6, and are not affected by any future closure of the training portal.3. Access & Delivery

4. Student Responsibilities

You agree to:

  • Complete all coursework, quizzes, and assessments within the stated timelines.
  • Participate in the Program in a professional and respectful manner.
  • Maintain confidentiality of proprietary course content, client case materials, and peer submissions.
  • Use the ColorEssence name, system, and assets only as permitted under the active license.

5. Certification Requirements

To be certified, you must:

  • Score at least 80% on all module quizzes. Retakes are unlimited.
  • Complete all 12 seasonal practice cases and pass the accompanying quiz with 100% accuracy, correctly identifying every season. Retakes are unlimited.
  • Submit and pass a Book Report on a foundational color theory text (pass/fail).
  • Meet with a Company instructor for a 1:1 review prior to submitting your final Capstone Project.
  • Submit and pass the Capstone Project: a full client color analysis and report, chosen from one of four provided client cases (pass/fail).
  • Complete all requirements within 6 months of your Program start date.

Extensions. If you have not completed all requirements within 6 months, you may extend your access in 3-month increments for a fee of $99 per quarter, for as long as needed to complete certification. There is no limit on the number of extensions available.

Together, the 12 practice cases and the Capstone Project comprise your 16 total practicum cases.

6. Certification Use Terms

Upon successful certification, you are granted a permanent, non-exclusive, non-transferable license to:

  • Use the title ColorEssence Certified™ 12-Season Color Analyst.
  • Use Company-provided templates, brand assets, and client-facing materials for the sole purpose of delivering color analysis services to your own clients.

This license does not expire and is not contingent on renewing your directory listing or Mastermind enrollment. It may be revoked only for a violation of these Terms, as described in Section 18 (Termination).

You may not, at any time:

  • Teach, train, or certify others using the ColorEssence system or methodology.
  • Sell, share, or redistribute Program materials outside your own paid client work.
  • Use Company trademarks, logos, or system names in any way not authorized in writing.

You agree not to copy, duplicate, modify, publish, display, distribute, reproduce, store, transmit, post, create derivative works from, reverse engineer, sell, rent, or license any part of the Program content to any third party without the Company’s prior written consent. You agree to abide by all applicable copyright, trademark, and intellectual property laws, and are solely responsible for any violation of these terms.6. Certification and Use Terms

7. Certification & Listing Renewal

Upon successful completion of all Program requirements, your ColorEssence Certified™ 12-Season Color Analyst certification and badge are awarded permanently and do not expire. Once earned, this credential is yours to hold and reference indefinitely, regardless of whether you maintain any optional add-on services described below.

Directory Listing. Inclusion on the Company’s public “Find a Color Analyst” directory is a separate, optional benefit renewed annually for a fee of $99/year. If your listing renewal lapses, you will be removed from the public directory, but your certification, badge, and title remain unaffected and fully yours to use as permitted under Section 6B.

8. Payments & Fees

  • Tuition is due in full or via an approved installment plan at enrollment.
  • Payment plans must be completed in full, regardless of whether you finish the Program, unless otherwise stated in writing.
  • Late payments may result in suspension of access and/or termination from the Program.

9. Refund Policy

All Program sales are final and non-refundable.
If you withdraw, fail to complete the Program, or do not meet certification standards, no refunds will be issued.

10. Chargebacks

Initiating a chargeback is a breach of these Terms. If you file a chargeback, we reserve the right to:

  • Immediately revoke your course access and licensing rights.
  • Report the incident to credit bureaus or industry fraud databases.
  • Pursue the balance owed, plus any collection costs.

11. Intellectual Property

All Program content, materials, templates, processes, and the ColorEssence system are protected by copyright, trademark, and other proprietary rights and remain the sole property of the Company.
You receive a limited license to use these materials only as described in Section 6. Any unauthorized use will result in termination and possible legal action.

12. Confidentiality

You agree to maintain the confidentiality of all proprietary information, including course content, peer discussions, and any private community communications. Exceptions apply only where disclosure is required by law.

13. Code of Conduct

As a Student, and if certified, as a ColorEssence Certified™ 12-Season Color Analyst, you agree not to:

  • Harass, abuse, or disrupt other students, staff, instructors, or Mastermind members.
  • Use any Company community space (including coursework discussions, Mastermind calls, coworking sessions, or private groups) for unsolicited self-promotion or solicitation.
  • Share your login credentials or grant portal access to any non-enrolled individual.
  • Misrepresent your certification status, credentials, or standing with the Company to clients, colleagues, or the public.
  • Conduct client color analysis sessions in a manner that is negligent, deceptive, or inconsistent with the training and standards taught in the Program.

Enrollment in good faith. You represent that you are enrolling for your own professional development and to build your own color analysis practice. Enrolling for the purpose of studying, copying, screenshotting, recording, or otherwise extracting Program content, methodology, templates, or materials in order to build, teach, sell, or improve a competing product, course, or certification is a material breach of these Terms, regardless of whether that competing offering ever launches.

This includes, without limitation: reproducing Program materials to train or “certify” others outside the Company’s own system, incorporating substantial elements of the 5-Step Color Analysis Method™ or 12-Season Flow System into a separately branded framework, or sharing Program content with any individual or organization developing a competing offering.

Violation of this section entitles the Company to immediately terminate your enrollment and license without refund, and to pursue all remedies available under Section 11 (Intellectual Property) and applicable law.

If certified and listed on the Company’s public directory, you additionally agree to maintain conduct consistent with representing the ColorEssence Certified™ standard in your public-facing work, including accurate representation of your services, honest client communication, and professional conduct in any client-facing capacity.

Violation of this Code of Conduct may result in removal from the Program without refund, revocation of directory listing, removal from Mastermind, and/or termination of your license as described in Section 18.

14. Professional Advice Disclaimer

This Program provides professional style and image training. It does not provide legal, financial, or medical advice. You are solely responsible for how you implement the training in your own business.

This Program is intended solely for educational purposes in the areas of color analysis and online business marketing. It does not constitute a business opportunity, franchise, or guarantee of future employment. Purchasing this Program does not create an offer of a business, partnership, or employment relationship.

15. Earnings Disclaimer

Any earnings, income statements, testimonials, or examples referenced in this Program represent individual results in specific circumstances. They are provided for illustrative purposes only and should not be considered typical. There is no assurance that you will achieve similar outcomes. Your success depends on many factors outside our control, including your own skills, effort, market conditions, and client relationships.

You agree that the Company is not responsible for your earnings, business performance, or financial outcomes as a result of participation in the Program.

16. Testimonials

Testimonials, examples, and success stories shared in the Program or on the Company’s website are from actual clients and students. They are provided for illustration only and are not intended to guarantee that you will achieve the same or similar results.
If you submit a testimonial, review, or feedback, you grant the Company the right to use and publish it (with your name and/or image) in any marketing or promotional materials without requiring further consent or compensation.

17. Limitation of Liability

To the fullest extent permitted by law, the Company’s total liability to you shall not exceed the amount you paid for the Program. We are not liable for any indirect, incidental, or consequential damages.

18. Termination

We may terminate your enrollment or license immediately if you:

  • Breach these Terms or the Licensing Agreement
  • Fail to meet payment obligations
  • Misuse or misrepresent the ColorEssence brand or materials

Upon termination, you must cease all use of ColorEssence materials and remove any references to your certification.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA. Any disputes shall be resolved through binding arbitration in Texas, with each party responsible for its own costs unless otherwise ordered.

20. Miscellaneous

  • Entire Agreement: These Terms, plus your signed Licensing Agreement, constitute the full understanding between you and the Company.
  • Severability: If any part is found unenforceable, the remainder stays in effect.
  • Assignment: You may not transfer your rights under these Terms without written permission.

By enrolling in the Program, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
