Foundations Certification – Terms & Conditions
Effective Date: Date of enrollment (digital acceptance required at checkout)
Company: Marvelous Works LLC (“Company,” “we,” or “us”)
Student: The enrolled participant (“Student,” “you,” or “your”)
By enrolling in the ColorEssence Foundations: 12-Season Color Analysis Certification Program (the “Program”), you agree to the following Terms & Conditions. Your acceptance via checkbox at checkout constitutes your digital signature and binding agreement.
1. Program Description
The Program is a 6–12 week professional training that equips you to conduct accurate, ethical seasonal color analysis using the ColorEssence 12-Season Method.
The training portion is delivered over 6 weeks, followed by an additional 6 weeks for completing certification requirements.
Certification is awarded only upon successful completion of all required modules, assessments, and licensing agreements. Enrollment does not guarantee certification.
2. Eligibility
You must:
- Be at least 18 years of age and legally able to enter into a binding contract.
- Enroll for your own participation (no proxy attendees).
- Have basic technology skills to access online materials, submit assignments, and participate in assessments.
3. Access & Delivery
- Program is delivered online via a secure portal.
- Includes pre-recorded lessons, transcripts, quizzes, assignments, and live Q&A sessions.
- Lifetime access to Program content as it existed at your time of enrollment, unless the Program is retired, in which case access will close.
- Licensing assets (badge, templates, stylist portal) are granted only upon certification and remain active while your license is current.
4. Student Responsibilities
You agree to:
- Complete all coursework, quizzes, and assessments within the stated timelines.
- Participate in the Program in a professional and respectful manner.
- Maintain confidentiality of proprietary course content, client case materials, and peer submissions.
- Use the ColorEssence name, system, and assets only as permitted under the active license.
5. Certification Requirements
To be certified, you must:
- Score at least 80% on all module quizzes (up to three attempts each).
- Submit and pass a Book Report on a respected color analysis text (pass/fail).
- Submit and pass the Capstone Project: Client Analysis Report (accuracy, reasoning, professionalism).
- Complete all requirements within 12 weeks from program start.
Extensions: You may request one (1) free three-month extension to complete certification requirements. Additional extensions are available at $99 per quarter.
Failure to meet these requirements will result in non-certification and loss of eligibility for licensing. Re-enrollment or extension fees may apply.
6. Licensing Terms (Overview)
Upon certification, you are granted a non-exclusive, non-transferable, revocable license to:
- Use the title ColorEssence Certified™ 12-Season Color Analyst.
- Use Company-provided templates, brand assets, and client-facing materials for the sole purpose of delivering color analysis services to clients.
You may not:
- Teach, train, or certify others using the ColorEssence system.
- Sell, share, or redistribute Program materials outside your own paid client work.
- Use Company trademarks, logos, or system names in any way not authorized in writing.
For full licensing details, including enforcement and renewal processes, refer to your separate Licensing Agreement, which must be signed prior to receiving licensing access.
7. License Renewal
- Certification and licensing are valid for 12 months from completion.
- Renewal requires:
- Payment of renewal fee (you will receive notification/reminder)
- Signing the updated license agreement
- Attending at least one quarterly training (live or replay)
- Providing proof of client work or engagement
- Completing any additional documentation required by the Company
Failure to renew will result in license lapse and immediate loss of access to all licensing materials, brand assets, and certification references.
8. Payments & Fees
- Tuition is due in full or via an approved installment plan at enrollment.
- Payment plans must be completed in full, regardless of whether you finish the Program, unless otherwise stated in writing.
- Late payments may result in suspension of access and/or termination from the Program.
9. Refund Policy
All Program sales are final and non-refundable.
If you withdraw, fail to complete the Program, or do not meet certification standards, no refunds will be issued.
10. Chargebacks
Initiating a chargeback is a breach of these Terms. If you file a chargeback, we reserve the right to:
- Immediately revoke your course access and licensing rights.
- Report the incident to credit bureaus or industry fraud databases.
- Pursue the balance owed, plus any collection costs.
11. Intellectual Property
All Program content, materials, templates, processes, and the ColorEssence system are protected by copyright, trademark, and other proprietary rights and remain the sole property of the Company.
You receive a limited license to use these materials only as described in Section 6. Any unauthorized use will result in termination and possible legal action.
12. Confidentiality
You agree to maintain the confidentiality of all proprietary information, including course content, peer discussions, and any private community communications. Exceptions apply only where disclosure is required by law.
13. Code of Conduct
You agree not to:
- Harass, abuse, or disrupt other students or staff.
- Use the community for self-promotion or solicitation without permission.
- Share login credentials or grant access to non-enrolled individuals.
Violation may result in removal from the Program without refund.
14. Professional Advice Disclaimer
This Program provides professional style and image training. It does not provide legal, financial, or medical advice. You are solely responsible for how you implement the training in your own business.
This Program is intended solely for educational purposes in the areas of color analysis and online business marketing. It does not constitute a business opportunity, franchise, or guarantee of future employment. Purchasing this Program does not create an offer of a business, partnership, or employment relationship.
15. Earnings Disclaimer
Any earnings, income statements, testimonials, or examples referenced in this Program represent individual results in specific circumstances. They are provided for illustrative purposes only and should not be considered typical. There is no assurance that you will achieve similar outcomes. Your success depends on many factors outside our control, including your own skills, effort, market conditions, and client relationships.
You agree that the Company is not responsible for your earnings, business performance, or financial outcomes as a result of participation in the Program.
16. Testimonials
Testimonials, examples, and success stories shared in the Program or on the Company’s website are from actual clients and students. They are provided for illustration only and are not intended to guarantee that you will achieve the same or similar results.
If you submit a testimonial, review, or feedback, you grant the Company the right to use and publish it (with your name and/or image) in any marketing or promotional materials without requiring further consent or compensation.
17. Limitation of Liability
To the fullest extent permitted by law, the Company’s total liability to you shall not exceed the amount you paid for the Program. We are not liable for any indirect, incidental, or consequential damages.
18. Termination
We may terminate your enrollment or license immediately if you:
- Breach these Terms or the Licensing Agreement
- Fail to meet payment obligations
- Misuse or misrepresent the ColorEssence brand or materials
Upon termination, you must cease all use of ColorEssence materials and remove any references to your certification.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, USA. Any disputes shall be resolved through binding arbitration in Texas, with each party responsible for its own costs unless otherwise ordered.
20. Miscellaneous
- Entire Agreement: These Terms, plus your signed Licensing Agreement, constitute the full understanding between you and the Company.
- Severability: If any part is found unenforceable, the remainder stays in effect.
- Assignment: You may not transfer your rights under these Terms without written permission.
By enrolling in the Program, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
